1. Definitions

• "Client," "you," or "your" refers to the individual or entity engaging with our services.

• "Services" refer to brand strategy, design, illustration, and any other creative solutions offered by Ghost Bird Creative.

2. Services

Ghost Bird Creative provides branding, design, and illustration services tailored to your needs. All projects are subject to a written agreement specifying deliverables, timelines, and payment terms.

Project Scope & Revisions

• All projects include a set number of revisions as outlined in the project agreement.

• Additional revisions may be subject to additional fees.

• Any changes to the agreed-upon scope may require a new contract and pricing adjustment.

3. Payment & Fees

• A non-refundable retainer (typically 50%) is required to commence work.

• Final payment is due upon completion of the project, before the release of final deliverables.

• Late payments may incur a penalty fee.

• All prices are listed in Canadian Dollars and are subject to applicable taxes.

4. Intellectual Property

• All original work created by Ghost Bird Creative remains our intellectual property until full payment is received.

• Upon full payment, the client receives a license to use the deliverables as outlined in the project agreement.

• We reserve the right to showcase completed work in our portfolio, unless otherwise agreed in writing.

5. Cancellations & Refunds

• If the client cancels a project before completion, the deposit is non-refundable.

• If work has commenced, the client may be invoiced for work completed beyond the deposit amount.

• Ghost Bird Creative reserves the right to terminate a project due to lack of communication, failure to pay, or breach of contract.

6. Confidentiality

• Both parties agree to keep confidential any proprietary information shared during the project.

• We may feature completed work in our portfolio unless otherwise agreed in writing.

7. Liability

• Ghost Bird Creative is not liable for any indirect, incidental, or consequential damages arising from the use of our services.

• Clients are responsible for reviewing and approving final deliverables; we are not liable for any errors found after approval.

8. Third-Party Services

• We may recommend third-party services (e.g., printers, web developers), but we are not responsible for their performance or outcomes.

• Clients engaging with third parties do so at their own risk.

9. Governing Law

These Terms and Conditions are governed by the laws of British Columbia Canada. Any disputes shall be resolved in the appropriate courts of this jurisdiction.

10. Modifications

We reserve the right to update these Terms and Conditions at any time. Continued use of our services after modifications indicates your acceptance of the revised terms.
